These Terms and Conditions of Use (the "Terms of Use") apply to the Wristo website located at www.wristo.io, and all associated sites linked to www.wristo.io by WuKong OÜ and its affiliates (collectively, the "Site"). The Site is the property of WuKong OÜ ("Wukong") and its licensors.

BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

Wukong reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms of Use at any time. It is your responsibility to check these Terms of Use periodically for updates. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Wukong grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

2. Products and License of Use

Wristo.io offers downloadable digital watch faces ("Products") for Garmin smartwatches. By purchasing or accessing any Product from the Site, you are granted a limited, non-exclusive, non-transferable, and revocable license to download, install, and use such Products solely for your personal, non-commercial use on compatible devices.

• The license granted does not constitute a sale of the Product or any intellectual property rights therein.
• You shall not sublicense, resell, redistribute, copy, reproduce, modify, or otherwise exploit the Products for any commercial purpose.
• You shall not reverse engineer, decompile, disassemble, or attempt to derive the source code or structure of any Product or component thereof.
• All rights not expressly granted herein are reserved by WuKong OÜ and its licensors.

Violation of any of the foregoing terms may result in immediate termination of your license and access to the Products, in addition to any other legal remedies available to WuKong OÜ.

3. Payments

All purchases made through the Site are processed via third-party payment platforms, including but not limited to Paddle.com, acting as an authorized reseller and Merchant of Record. By placing an order, you agree to be bound by the terms and policies of the applicable reseller.

The total price of any Product, including applicable taxes, will be displayed at checkout. Prices may vary depending on your billing location and may include value-added tax (VAT), goods and services tax (GST), or other local taxes as required by law.

• WuKong OÜ does not directly collect or process payments, and any billing-related inquiries should be directed to the payment processor or reseller used at the time of purchase.
• You are solely responsible for ensuring the accuracy of the billing information you provide.
• All payments are final and non-refundable except as expressly stated in the refund policy or as required by applicable law.

WuKong OÜ reserves the right to modify the pricing of Products at any time without prior notice, and such changes shall not affect any purchases already completed.

4. Refund Policy

We want you to be completely satisfied with your purchase. If you are not satisfied for any reason, you can request a refund within 14 days of your purchase date. No questions asked.

• Send an email to support@wristo.io within 14 days of your purchase.
• Please include your order confirmation, transaction ID, or payment receipt in your email.
• Refunds will be issued to the original payment method used at the time of purchase.
• Refunds are typically processed within 3-5 business days after your request is approved. The actual time for the funds to appear in your account may vary depending on your payment provider.
• Refund requests made after 14 days from the date of purchase are generally not accepted, except as required by applicable law.
• We reserve the right to deny refund requests that are fraudulent or abusive.

5. User Data and Privacy

WuKong OÜ is committed to protecting your privacy and handling your data with transparency and care.

We only collect and process the email address you voluntarily provide at the time of purchase. This information is used solely for the following purposes:

• To notify you of updates or changes to the products you have purchased.

We do not collect, store, or process any additional personal information, including but not limited to:

• Name, billing address, or payment card details (which are handled solely by third-party payment processors such as Paddle.com);
• Device identifiers, location data, or usage statistics;

• To attempt to gain unauthorized access to any portion of the Site, user accounts, systems, or networks connected to the Site, whether through hacking, password mining, or any other means;
• To distribute or facilitate the distribution of malware, spyware, viruses, or any other harmful or disruptive code;
• To reverse engineer, decompile, or otherwise attempt to extract the source code or underlying ideas or algorithms of any part of the Site or Products, except as expressly permitted by law;
• To resell, sublicense, or commercially exploit the Products without prior written consent from WuKong OÜ.

WuKong OÜ reserves the right to monitor use of the Site and to suspend or terminate access to any user who violates this Acceptable Use Policy, with or without notice, at its sole discretion.

7. Disclaimer

All digital Products offered through Wristo.io are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, WuKong OÜ disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Warranties regarding uninterrupted or error-free operation of the Site or Products;
• Warranties that the Products will remain compatible with future versions of Garmin operating systems, software updates, or devices.

You acknowledge that digital Products may be subject to changes in device compatibility, platform policies, or external technical factors beyond our control. WuKong OÜ is under no obligation to update or maintain Products to support future firmware or hardware changes by Garmin or any third party.

Use of the Site and Products is at your sole risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, WuKong OÜ and its affiliates, officers, employees, agents, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with:

• The use or inability to use the Site or any Products;
• Unauthorized access to or alteration of your transmissions or data;
• Any third-party conduct or content on the Site;
• Any changes to or termination of the Site or Services.

In no event shall WuKong OÜ's total cumulative liability to you for any and all claims relating to the use of the Site or Products exceed the total amount you paid to WuKong OÜ for the specific Product(s) in question within the six (6) months preceding the event giving rise to the liability.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in full.

9. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, your use of the Site, or any Products purchased via Wristo.io shall be submitted to the exclusive jurisdiction of the courts of Estonia, with Tallinn, Harju County as the agreed legal venue.

You hereby irrevocably consent to the personal and exclusive jurisdiction of such courts and waive any objections based on venue or forum non conveniens.
